WHAT THE NOW

Instead of producing an MMO, 38 Studios produced an ongoing legal battle of finger-pointing and agony over the state of Rhode Island’s $75 million loan to the company. Those deemed responsible for the deal are being sued, naturally, but four of the defendants in the case have reached an out-of-court settlement to the tune of $12.5 million. A hearing on the settlement is scheduled to take place on August 21st, and while the defendants in question maintain their innocence, the official statement is that it would be in the best interests of everyone to avoid a full trial.

A previous settlement in the case saw another defendant settling for $4.4 million in damages. There are still several further defendants in the lawsuit, including Curt Schilling himself and several investment banks involved in the initial deal; time will tell if settlements are sought by these parties as well or if they are more confident going to trial.
